These Terms of Service (the "Terms") govern your access to and use of the Corner Kits order portal (the "Service") operated by Corner Kits ("we," "us," or "our"). By accessing or using the Service — including by building or submitting an order — you agree to these Terms. If you do not agree, do not use the Service.
The Service lets you configure and submit orders for custom, made-to-order sublimated apparel, upload a design, provide roster and delivery details, and track your order. Products are produced to order based on the information you submit.
You must be at least 18 years old and able to form a binding contract to use the Service. If you submit an order on behalf of a team, company, or organization, you represent that you are authorized to do so and to provide the information included in the order.
You are responsible for the artwork, logos, names, numbers, and other content you upload or provide (your "Content"). You represent and warrant that you own or have all necessary rights and permissions to use your Content and to have it reproduced on apparel, and that it does not infringe any third party's intellectual property, publicity, or other rights. You grant us and our production partner a limited license to use, reproduce, and modify your Content solely to produce and fulfill your order. We may decline to produce content that we believe is unlawful, infringing, or offensive.
Payment terms are as communicated for your order. Where online payment or financing is offered, it is processed by our third-party providers (such as Intuit QuickBooks Payments and its financing partners). We do not store your card numbers. You are responsible for all amounts due for your order.
Production and delivery timeframes shown in the Service are estimates and are not guaranteed. Risk and responsibility for delays outside our control (including shipping carriers and customs) are not assumed by us. You are responsible for providing accurate delivery information.
You agree not to misuse the Service, including by attempting to disrupt it, access it without authorization, submit unlawful or infringing content, or use it for any purpose other than legitimate ordering.
The Service, including its software, design, and content (excluding your Content), is owned by us or our licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service to place and manage your orders. You may not copy, modify, or reverse-engineer the Service.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted or error-free. Minor variations in color, placement, and sizing are inherent to custom sublimated manufacturing.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR AN ORDER WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE ORDER GIVING RISE TO THE CLAIM.
You agree to indemnify and hold us harmless from claims arising out of your Content, your violation of these Terms, or your violation of any law or third-party right.
We may update these Terms from time to time. Changes are effective when posted on this page, and continued use of the Service constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules.
